What Is A Scapula Fracture Or Broken Shoulder Blade?
A scapula fracture, or broken shoulder blade, can be a very debilitating injury because it affects your arm’s mobility. As a result of the injury, you may be unable to care for yourself, drive or return to work. In addition to this, you may experience pain and suffering as a result of the injury. It can have a very negative impact on your quality of life.
You may be wondering, “What does a fractured scapula feel like?”. The NHS website includes information on scapula fracture symptoms. They can include:
- Pain occurring straight after the injury
- Bruising and swelling
- An inability to move or put pressure on the arm
Broken scapula treatment
If you’re wondering, “What do they do for a broken scapula?” it depends on the complexity of the injury. For example, you may suffer a clavicle and scapula fracture. If this is the case, you could potentially claim for both injuries.
A glenoid scapula fracture is where the shallow “socket” of the ball-and-socket shoulder joint is fractured. If this fracture is unstable or displaced, you may need broken scapula surgery. This is where pins and plates are inserted into the bone to keep it in position as it heals.
Surgery to fix a broken scapula is rarely required, however. Usually, your doctor or medical professionals will provide you with pain relief and assess the injury by using an X-ray. Once the injury is confirmed, they will usually apply a sling to the arm to be worn as it heals.
The question “how long does it take to recover from a broken scapula?” is a common one. Injuries of this nature usually take two to six weeks to heal. However, some scapula fracture symptoms can take longer to go away.
You should always listen to your doctor and follow their instructions for the best chance of making a full recovery. For example, they may give you exercises to perform or arrange for you to attend physiotherapy to help you regain your full range of motion.
If you’re left unable to work or have experienced a decline in your quality of life because of a scapula fracture, our compensation calculator could be useful. Alternatively, you can speak to a member of our team today for more free legal advice.
Broken Scapula – How Long Do You Have To Claim?
When making a personal injury claim for a broken scapula, it is important to remember that you only have a certain amount of time to start your claim. The time limits for personal injury claims can be found in the Limitation Act 1980, and they generally are:
- 3 years from the date of the accident that caused you to sustain a fractured scapula.
- 3 years from the date you first realised that your injury was caused by negligence. This is known as the ‘date of knowledge’.
However, there are certain exceptions to these time limits. For example:
- If someone lacks the mental capacity to make a claim for their broken shoulder blade, a litigation friend could make a claim on their behalf. This is someone appointed by the court and could be a family member, friend or solicitor. If no claim is made on their behalf and the person recovers their mental capacity, they will have 3 years to start their claim from the date of recovery.
- If your child has been injured, a litigation friend could make a claim on their behalf. If this is not done, they will have 3 years to start their claim once they turn 18.
Remember, for all personal injury claims, you must prove that your injury was caused by a third-party breaching their duty of care.
Do not hesitate to contact our advisors today if you an unsure whether you are eligible to make a claim for your fractured shoulder blade. An advisor can also discuss the exceptions to the time limits that may apply.
Accidents Which Could Cause A Broken Shoulder Blade
There are a number of different kinds of incidents that could lead to a shoulder blade fracture. But in order to make a successful personal injury claim, you need to be able to show that your injury was caused by third-party negligence.
Negligence is where a third party had a duty of care to you, and this duty was breached. If you’re injured as a result of this breach, you may be able to make a claim.
This section will highlight examples of negligence that could cause a broken shoulder blade in different circumstances. This will hopefully give you a better understanding of your own situation.
Motor Vehicle Driver Or Passenger Injuries
All road users have a duty of care to one another. They are expected to act with the standard of skill and care of the average motorist. Road users can find guidance on safe road conduct in the Highway Code.
Examples of negligence on the road could include:
- A driver is distracted by reading a map and fails to notice you walking across a zebra crossing. As a result, they knock you over, and you break your shoulder as a result.
- Before pulling out of a junction, a driver fails to check the road in both directions. This leads to them pulling out and colliding with the side of your car, meaning that your shoulder is fractured.
- A motorcyclist turns onto a roundabout without giving way to traffic on their right, causing them to collide with you. This could cause a shoulder fracture, leading to pain and suffering and you being unable to drive for months. As a result, you may want to use a compensation payout calculator.
One thing to consider when making a road traffic accident claim: if you’re a driver or passenger over the age of 18 and your injuries are worth less than £5,000, you will have to claim through a different method. This is outlined in The Whiplash Injury Regulations 2021.
However, you can still call us before claiming through this method. You may initially assume that your injuries are worth less than they actually are.
Falling Onto An Outstretched Arm
Those in control of public places (referred to as the “occupier”) also have a duty of care to every member of the public that uses their facilities for the purpose intended. They have a responsibility to take all reasonably practicable steps to ensure that the space is safe to use. This is outlined in the Occupiers’ Liability Act 1957.
Examples of negligence on the part of the occupier of a public space could include:
- Slipping on a mat that did not grip the floor properly.
- Tripping over on a loose floor tile and attempting to break your fall with your arm.
- Slipping and falling on a wet floor with no warning signs. This could lead you to have a broken scapula bone in the form of a glenoid scapula fracture.
Falling From A Height
Employers have a duty of care to their employees while they are working. They have a responsibility to take all reasonably practicable steps to reduce the risk of injury to workers. This is outlined in the Health and Safety at Work etc. Act 1974.
This means that if you’ve been injured in the workplace because of your employer’s negligence, you may be able to make a successful claim. Examples of negligence that could result in an accident at work include:
- Falling off a faulty ladder that breaks as you climb it. This could lead to you suffering an avulsion fracture to your scapula.
- Suffering from fractured scapula pain after falling through old, weak floorboards. If your employer failed to carry out proper risk assessments in the workplace, leading to this hazard being missed, then you could be owed compensation.
- Falling due to insufficient safety equipment, such as unsafe scaffolding, could result in a scapula fracture work injury.
Traumatic Physical Attacks And Assaults
Violence caused by incidents such as assault could lead to you seeking criminal injury compensation. To do this, you can claim through The Criminal Injuries Compensation Authority (CICA). If you choose to do this, our panel of No Win No Fee solicitors can still help build your case.
The compensation you could receive from the CICA is in the Criminal Injuries Compensation Scheme tariff of injuries. Examples of incidents where you could claim through CICA include:
- Suffering physical and psychological injuries after being sexually assaulted.
- Being pushed over while you’re being mugged, resulting in you hitting the ground with your shoulder and fracturing your scapula.
- Being badly beaten in the process of your car being stolen. You could suffer multiple injuries from such an incident, including a broken leg and a fractured pelvis.
Criminal Injury Statistics
The Office for National Statistics (ONS) provides annual reports of crime in England and Wales. In their latest figures for the year ending March 2021, figures for knife-enabled crime were lower than the previous year. For instance, in the figures from March 2020, there were 21,508 robberies conducted using knives. In the latest figures, robberies involving knives or sharp objects were down to 20,366 instances.
While the figures have decreased, the graph above shows that homicides using knives were the most common in the period April 2019- March 2020. If you were stabbed in the shoulder, this could damage your scapula and may also cause you nerve damage. This can cause you severe ongoing repercussions.
Our scapula fracture compensation calculator can give you an estimate of what you could receive in minutes. If you prefer, you can call one of our advisors for free legal advice using the phone number at the top of this page.
Claiming Physical And Medical Care Costs
Due to the potentially debilitating nature of a scapula fracture, there may be various financial losses you’re looking to claim back. As part of this, you may also want to claim for care costs. These are bills you’ve had to pay throughout the recovery process. You will need evidence to prove these losses.
Care costs might include things like:
- Prescriptions and medicine
- Private physiotherapy to help you regain
- Gracious care because a loved one has time off work to take you to appointments.
Check How To Estimate Your Settlement
Our personal injury calculator can give you a compensation estimate that takes into account any loss of earnings you have experienced, too. Tell us a few details about your injury and any financial losses you’ve experienced due to it. It will then give you a breakdown of what you could receive.
The Judicial College analyses general damages compensation payouts for many different types of injuries. They review the amount of compensation and compare it to the injury itself, accomodating for its respective severity. They’ve created guideline compensation brackets that legal professionals can use to help value compensation claims.
How Much Could I Expect To Claim For A Broken Shoulder Blade?
The general damages head of your claim is the part of your claim that compensates you for your injuries themselves including the pain and suffering. Therefore, general damages will be assessed based on the severity of your injury and how it has impacted you.
As part of your claim, you will usually be invited to an assessment with an independent medical expert. They will assess your injuries, confirm that they were caused by your accident and detail their findings and prognosis in a report. This report will be used alongside the Judicial College Guidelines to help value your claim.
Special damages relate to the financial losses you’ve suffered due to the injury. For this part of the claim to be potentially successful, you will need to supply evidence to highlight the losses. Evidence can include things like:
- Receipts
- Bank statements
- Invoices

How Do Scapula Fracture Compensation No Win No Fee Agreements Work?
You may be wondering what the phrase “No Win No Fee” means. After all, it’s a phrase many people have heard but that you may not have a full understanding of.
A No Win No Fee agreement can also be referred to as a Conditional Fee Agreement. It sets out the terms that need to be met before your solicitor asks for payment and means that:
- Your personal injury solicitor will not request legal fees from you upfront or during the claims process.
- Your personal injury solicitor will not request you to pay legal fees if your claim is unsuccessful.
- Instead, they will take a legally capped portion of your compensation as payment upon your claim being successful. This is known as a “success fee”.
A No Win No Fee agreement presents a financial risk to the solicitor. Because of this, they will only offer this kind of agreement if they feel you have a reasonably good chance of success.
