How To Use A Personal Injury Pain And Suffering Settlement Calculator
A personal injury pain and suffering settlement calculator can easily and quickly provide you an accurate estimate of what you could receive. In just a few clicks, it can provide you with a compensation bracket that will make you understand more about what your injury could be worth.
These compensation brackets are based on payouts given by the courts in previous personal injury claims. The Judicial College has created these brackets based on the severity and nature of every single type of injury. This answers such questions as “How much should I settle for pain and suffering?” and “How are personal injury settlements calculated?”
In relation to general damages compensation, you would either receive the amount they deem that your injury is worth or your claim will be unsuccessful. They could, however, theoretically only agree that some of your injuries were due to the incident. As such, the potential settlement amount is reviewed on a case-by-case basis.
The compensation brackets help give a breakdown of what you could receive for each individual injury and, in that, help you understand what you could be awarded.
Pain And Suffering Settlement Examples In The UK
As mentioned before, you can use our personal injury pain and suffering settlement calculator to get more information on the potential value of your claim. A payout for a successful personal injury claim can include general damages and special damages.
General damages compensate you for the pain and suffering caused by the injuries you’re claiming for.
The table included below includes some of the compensation guidelines found in the Judicial College Guidelines (JCG). This document may be used by those valuing your personal injury claim for general damages, since it lists various types of injuries alongside guideline compensation brackets.
Take note that the table below should be viewed as a guide only. Also, the first entry in the table is not taken from the JCG.

Types And Causes Of Pain And Suffering
Many incidents can lead to you wanting to use a personal injury pain and suffering settlement calculator. Particularly severe injuries can have a damaging effect on your life, and you’re more than within your right to see if you’re able to claim for the pain and suffering caused.
Below are examples of just some types of incidents that you would be able to claim for to better understand your own situation.
Accidents At Work
An accident at work can cause debilitating and difficult injuries to deal with, particularly if you work in manual labour. This can result in you being unable to work and, as such, can lead to financial difficulties.
Like with all personal injury claims, whether you can claim or not revolves around showing that someone else was negligent. Your employer has a duty of care to their employees to make sure they can work their role to the best of their abilities safely and securely. They would be liable for your injury if they were not ensuring this, and your injury was caused due to their negligence. Your employer’s duty of care is detailed in full in the Health and Safety at Work etc. Act 1974.
Examples of how your employer can breach their duty of care includes:
- You being asked to lift an object that is too heavy for you to carry, causing back pain. This could result in you wanting to use a personal injury pain and suffering settlement calculator.
- Wanting to make a personal injury pain and suffering claim due to unsafe work conditions. For example, this could be from you falling downstairs due to a faulty handrail.
- Looking to make a personal injury claim for pain and suffering due to you injuring yourself because of malfunctioning equipment. This could be due to the necessary safety checks not being performed on the item in question.
Road Traffic Accidents
Road traffic accidents can cause a great deal of pain and suffering. Millions of people use the roads in the UK every day and, due to the sheer number of road users, accidents are bound to happen. The Highway Code was created to stop accidents caused by negligence but, unfortunately, they still occur.
The Highway Code sets out every road user’s duty of care so, when they breach it, they are being negligent and could be deemed liable if one or multiple injuries are caused due to it. Examples of this include:
- A driver running through a red light causing a side collision with your vehicle. This could result in you wanting to use a personal injury pain and suffering calculator.
- A car swerving sharply into your lane on the motorway. More serious accidents like this can cause a multi-car pile-up.
- Wanting to use a personal injury claims calculator due to a driver going over the speed limit and, as such, causing a rear-end collision with your vehicle.
Something else to bear in mind with these types of injuries: if the value of the harm you’ve sustained comes to less than £5,000, there is a different method of claiming that you would have to use. This is outlined in The Whiplash Injury Regulations 2021. However, we always recommend getting in touch first before going down this route—your claim may be worth more.
Slips, Trips And Falls
You could also be seeking personal injury pain and suffering compensation due to a slip, trip or fall. The degree to which the injury has affected you, both physically and mentally, will determine the answer to questions such as “How much is pain and suffering worth?”
You may have injured yourself in a public place and be unsure of who is liable for the injury. The third-party in control of the space will be liable for the damage if their negligence has caused you to be injured. Their responsibility is to make sure, within reason, that you’re safe and able to enjoy the facilities they’re offering without risk of injury. Their duty of care is detailed further in The Occupiers’ Liability Act 1957.
Examples of slips, trips and falls that could cause you to want to use a personal injury pain and suffering settlement calculator include:
- A kerbstone that has been pushed higher by adverse weather could lead to people tripping and falling. In such cases, if the local council is aware of the hazard, they should take steps to make it safe.
- You slipping on a wet floor with no warning signs present.
- Carpet or flooring not being installed correctly, leaving a trip hazard which has resulted in you falling.
